Florida Claim Settlement Versus Lawsuit Trial

A Florida personal injury lawsuit is most often settled out of court through negotiations with the other party and the insurance companies. Many insurance companies don't want to take a case to trial because it can be expensive to defend a case in court. Instead, there may be a series of negotiations or discussions in an effort to seek a mutual resolution for compensation, called a settlement, prior to trial.

If there is no agreed upon settlement by both parties, it's possible that the personal injury case will proceed to trial. During trial, both sides will present evidence, put witnesses on the stand and argue for their desired outcome.

The plaintiff's attorney, the attorney for the accident victim filing suit against the other party, may request a jury trial or a judge (or bench) trial. Regardless of whether a judge or a jury decides the outcome of the case, the trial will result in a decision on whether negligence contributed to the accident and the amount of damages awarded, if any. In some limited circumstances, the victim may be able to appeal an unfavorable trial result.
